Operating Rules

General Functioning

  1. In order for the Buyer and Seller to enter the system, they must have received the e-payment (Receipt) number sent by Land Registry Directorate via text message (SMS) after application to Land Registry Directorate.
  2. Record entries to TapuTakas System can be made via www.taputakas.com.tr or www.turkiye.gov.tr and TapuTakas mobile applications.
  3. Buyer and Seller real persons who want to take action on www.taputakas.com.tr must first create a user and password with their own credentials on the system.
  4. In the event of any request to be processed via e-Government Gateway, the buyer and seller must click on the ‘New Record Entry’ button on Tapu Takas (Payment of Real Estate Purchase and Sale Prices via Takasbank) Operations Screen after entering e-Government Gateway with their own credentials and passwords.
  5. The buyer and the seller perform the first phase of the system record entry by using the e-payment number and credentials through the ‘New Record Login’ option.
  6. The credentials of the buyer and the seller, are queried by Takasbank system via the e-payment (receipt) number from Land Registry and Cadastre Information System (TAKBIS) during record entry.
  7. In the second stage of the record entry; the title deed information, which is queried from Land Registry and Cadastre Information System (TAKBIS), is displayed and the parties move to the next stage by checking and confirming the deed information.
  8. In the next step; the buyer and the seller enter their own IBAN information and sales amount into the system.
  9. The IBAN number entered into the system (since identity information and IBAN verification is made) should not be a joint account, but an account that belongs only to the person himself/herself.
  10. Since the sum of the amounts entered into the system by the buyer and the seller party(s) must be equal to each other, in case of multiple buyers and sellers, each party must enter their own sales amount.
  11. Takasbank informs the buyer and the seller via text message (SMS) and e-mail (if entered into the system during record entry) for the transfer of the sales price and commission.
  12. The buyer and seller transfer the commission price and the buyer transfers the sales price from their own account that they entered in the system during record entry,by typing the e-payment number in the EFT description field,to Takasbank account number TR33 0013 2000 0000 0000 0240 45. (If EFT is performed through a different IBAN, the corresponding amount will be automatically returned to the sender account by Takasbank.)
  13. When buyer and seller commission fee and sales price are transferred to Takasbank account, the amount is blocked on behalf of buyer and seller.
  14. Before the transaction is carried out at Land Registry Directorate, it is important to make sure that the sales price is blocked by clicking on the "Query" button on www.taputakas.com.tr or www.turkiye.gov.tr or the mobile application, and that the deed transfer transactions are carried out after this inquiry. The parties are informed about the issue via text message (SMS) and e-mail (if specified during record entry).
  15. Takasbank queries whether the sale transaction has been carried out (the registration process has been carried out) from TAKBIS.
  16. When the property ownership right has been transferred at the Land Registry Directorate (when the registration is done), the sales price is transferred by EFT to IBAN notified by the seller by Takasbank.
  17. At every stage of the transactions, the parties are informed via text message (SMS). If an e-mail address is specified during record entry, parties will also be notified by e-mail. All notification messages (SMS and e-mail) sent by Takasbank are sent with the "Confirmation Code" to be sent during record entry, and it is important not to respect messages that do not have a "Confirmation Code" or are incorrect.

Record Update

  1. If the buyer and/or seller all parties have not completed their record entries into the system and there is no match (matching on the basis of the amount entered into the system by the buyer(s) and seller(s)), the record can be updated.
  2. Turkish Republic Identification Number/Tax Identification Number/Name and Surname/Identity Information cannot be updated after record entry is completed.
  3. If the commission or sales price for the record has been transferred, the IBAN information cannot be amended.
  4. If an amount over the commission fee is transferred to Takasbank, no updates can be made in any field.

Record cancellation

  1. If the buyer and/or seller all parties have not completed their record entries into the system (if there is no match), the record can be canceled.
  2. If the buyer and/or seller all parties have not completed the record entries into the system (if there is no match), they can cancel even if the money has been transferred. If a buyer who transfers the purchase price cancels without a match; the purchase price transferred to Takasbank is automatically returned to the sender via EFT.

Refunds to be made to buyers in case of non-realization of the sale transaction

    Ø Before matching of records;

    o Purchase price has been transferred to Takasbank by the buyer and 

    o If the title deed fee is not paid within three business days following the match, the sent purchase price is returned to the buyer's account, which was notified during the record entry, without the need for any further notice on the first business day following the match.

    Ø After matching of records;

    o Purchase price has been transferred to Takasbank by the buyer and

    o If the title deed fee is not paid within three business days following the date of receipt of the first purchase price after the match, the sent purchase price is returned to the buyer’s account notified during the record entry, without the need for any further notice at the beginning of the next business day.

    Ø If the purchase/sale transaction is given up provided that the transaction is canceled by the Land Registry Directorate after the title deed fee is paid, the blocked amount by Takasbank is returned to the buyer's account, which was notified during the record entry, via EFT.

    Ø Despite the payment of the title deed fee, if the purchase and sale transaction does not take place at the Land Registry Directorate within 29 calendar days (if the registration does not take place) or the purchase-sale transaction is not canceled by the parties; then the transferred sales amount is returned to the buyer’s account specified during record entry without any further notification on the 30th calendar day following the transfer of the title deed fee.
